The sign dangling from a fruit tree overhanging the footpath nearby caught my attention. My, someone is certainly upset that a passer-by has helped themselves to fruit in what’s apparently a public place.
Be that as it may, the sign is probably technically correct; the owner of the tree seems to be the owner of the fruit even if it’s the other side of the boundary. That’s the position as I remember it to be (but that was indeed a long time ago!) and it’s as stated here and consistent with the statement under “trees” here as well as here). Interestingly, however, the contrary is suggested here (and elsewhere on the web….). Is this a case of not allowing the legal position getting in the way of a passion for a cause?
